Medical Malpractice at an All-Time Low

By Oguz Ozdemir

ADVERTISEMENTS

Many different counties across the United States have seen all time low rates of medical malpractice in 2008. This is a very interesting turn of events as we have seen the rate of medical malpractice increase for decades. Whether the economy has something to do with it or not, one of the major reasons why the rate has decreased is because of new laws being enacted across the country. One major law recently put in place that has helped to decrease the amount of medical malpractice is the cap on damages. This means that there is maximum amount that a defendant can receive for a medical malpractice lawsuit if it is found that the medical professional or medical institution was at fault. Lawyers have stated that the cost of the extensive research and testimonials needed to prove medical malpractice may not be worth pursuing due to the cap amount of the settlement. People also get very discouraged when they see a case where the doctor is found innocent and the defendant is out a significant amount of money while still recovering from the act of medical malpractice. Whether the reduction of medical malpractice lawsuits is because of the cap or not, medical malpractice still exists but now may not be pursued do the extreme costs. If you or a loved one has fallen victim to an act of medical malpractice, contact experienced and knowledgeable lawyers at Napoli Bern Ripka, LLP today at nbrlawfirm.com.
