Properly Vetting Obama; Links to Numerous Articles

By Phil

ADVERTISEMENTS

At the bottom of this posting I have a rather comprehensive listing of vetting links provided by a concerned citizen.

-Phil

As the various eligibility lawsuits churn on, it is important to keep in mind that America’s founding fathers laid the onus of accountability for our leaders on us, “we, the People.” Hence the reason why our constitutional republic is based on the concept of government rule by the consent of the governed.

However, as blogger and attorney Mario Apuzzo opines,

Why do we currently have the massive debate over the question of whether Obama is constitutionally qualified to be President? On properly vetting Obama, our own political leaders, institutions, political parties, and main stream media have failed the people miserably and they should be taken to task after this is all said and done. One example of this failure can be seen from the August 12, 2008 interview by Hannity & Comes of Howard Wolfson, FOX News contributor and former Clinton communications director. Hannity asked: ?Do you regret not vetting, you know, Senator Obama the way he should have been?? Wolfson responded: ?No, I mean the media is tasked with the responsibility of vetting candidates. . . .? As we can see, all the players involved will simply point the finger at the other on the question of who was suppose to properly vet Obama. Another question that we need to ask is why was Obama not vetted properly?

A partial answer to this question is contained in my category, Qualifications, predominantly based on Justin Riggs’ work over at yourfellowcitizen.com.

However, “we the People” can be continuously more involved than to simply wait for Court cases to run their course. To that end, the following is an open letter to all US Senators provided by Dr. Doug Schell (www.restoretheconstitutionalrepublic.org):

OBAMA MUST STEP DOWN ON JANUARY 8, 2009

When the Senate meets on January 8, 2009 to talk about the results of the Electoral College vote, Mr. Obama must step down, as he does NOT meet the criteria for being POTUS, via the Constitution and Court cases throughout the years that say only a natural born citizen can be POTUS. Even Mr. Obama agrees with this because his vote was one of the unanimous votes for Senate Resolution 511, which he co-authored. Read for yourself and you will agree.

SENATE RESOLUTION 511

Whereas the Constitution of the USA states the qualifications of the President, a person must be a ??natural born Citizen?? of the United States;

Whereas the term ??natural born Citizen??, as that term appears in Article II, Section 1,is not defined in the Constitution of the United States;

Whereas there is no evidence of the intention of the Framers or any Congress to limit the constitutional rights of children born to Americans serving in the military nor to prevent those children from serving as their country?s President;

Whereas such limitations would be inconsistent with the purpose and intent of the ??natural born Citizen?? clause of the Constitution of the United States, as evidenced by the First Congress?s own statute defining the term ??natural born Citizen??;

Whereas the well-being of all citizens of the United States is preserved and enhanced by the men and women who are assigned to serve our country outside of our national borders;

Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President; and Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936:

Now, therefore, be it Resolved,

That John Sidney McCain, III, is a ??natural born Citizen?? under Article II, Section 1, of the Constitution of the United States. “Born to American citizens.?

The Senate Resolution that was adopted unanimously, with Mr. Obama?s approval, declares that natural born means ?born to American citizens.? The plural use of citizens implies that the mother and father are both American citizens.

This, therefore, disqualifies Mr. Obama. His father was NOT an American. He was born in Kenya, while it was under British rule. Mr. Obama states on his own website that he has dual citizenship.

FighttheSmears.com states:

?When Barack Obama Jr. was born on Aug. 4, 1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom?s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Senior?s children.?

As an aside, the resolution just mentioned was just that — a resolution. It is not a bill that has any legal standing whatsoever. Therefore, it legally cannot be used as a means of interpreting any clause of the Constitution. Naturally (pun intended), if Congress wanted to interpret a clause in the Constitution, they should pass a bill as such. However, such an action could be construed as improperly changing the Constitution and would have to be referred to the States as an amendment thereto.

Update: Here is a copy of the official Senate record from the US Government Printing Office.

Mr. Apuzzo goes on to say in the rest of the quoted posting:

Some concerned and well-informed Americans realize that our leaders have failed us in this regard and so have themselves demanded some straight answers-call it a vetting by We the People. These concerned Americans, in this time of crisis, have petitioned their government and political and legal institutions for help in resolving the question of whether Obama is Constitutionally eligible to be President. Their efforts have so far been in vain. Fortunately, these Americans have exercised their First Amendment right of free speech and have not had to rely on their government and these other institutions to have their grievance heard.

The internet has revolutionized society by giving individuals greater ability to guide their own destinies by participating in and benefiting from collective intelligence. Hence, concerned Americans have used the internet to bring to the fore the issue of Obama’s eligibility to be President and have placed their hope in the U.S. Supreme Court to decide that issue. Some brave attorneys and pro se litigants, who have had the courage to put their necks on the line, have helped these concerned Americans. We the people should be forever grateful to them, regardless of what the Supreme Court decides. This whole process shows that we the people will not be fooled so easily. We will and must stand up and fight until we get a straight answer.

Yet again, Congress cannot “fool all the People, all the time” (thank you, Abe Lincoln!).
