: Personal Injury Attorneys--Owen, Patterson & OwenOhio University Named in Malpractice Suit
By Owen, Patterson & Owen
Ohio University has been named as a defendant in a medical malpractice/wrongful death lawsuit. The two doctors named in the lawsuit, Dr. Rick Gemma and Dr. Roger Classen, may be immune from personal liability, because the doctors were teaching medical residents from OU’s College of Osteopathic Medicine at the time of the alleged malpractice, said the plaintiff’s attorney, Christian R. Patno. Last January the doctor?s patient, Edward F. Balcerzak, underwent a surgical laparoscopic assisted left hemicolectomy.
Nine days after the surgery, Balcerzak died due to vomiting and aspiration, which the lawsuit blames on the doctors’ “carelessness” and “negligence.” The lawsuit alleges the doctors improperly delegated post-operative orders concerning Balcerzak’s post-operative care, they failed to diagnose and respond to his digestive dysfunction, and failed to place a gastric tube and prevent vomiting and aspiration, properly and in a timely manner.
