By Francis G. X. Pileggi, Esq.

ADVERTISEMENTS

Sprint Nextel Corp. v. iPCS, Inc. (Del. Ch., Oct. 8, 2008), read opinion here. This Chancery Court decision involved a renewed Motion to Stay this Delaware case by defendants in favor of a concurrent action in Illinois. This motion was filed on Sept. 16, 2008 immediately after a decision by the judge in the companion case in Illinois denying a Motion to Dismiss those Illinois proceedings. In light of that decision and other developments after the July 14, 2008 denial of the initial Motion in Chancery Court  [see that decision summarized here on this blog], and “in the interest of comity, the efficient administration of justice, and achieving a complete and expeditious resolution of the underlying controversy", the Chancery Court granted the renewed Motion to Stay these proceedings.
