By classlawblog
As reported by the Rutland Herald, a federal judge in the District of Vermont recently certified a class action brought by pass holders against Killington Resort, a ski resort in the state.
The lawsuit was filed last year by holders of so-called ?investor? passes. These passes, issued between 1958 and 1965 as an incentive to invest in the then-fledgling ski area, were considered by their owners to be ?lifetime passes.? Some such passes have reportedly sold for up to $13,000. But last year the ski resort?s new owners, Killington Pico Ski Resort Partners and SP Land Co., informed the pass holders that they would no longer be honored after the 2008-09 ski season.
In his ruling, Judge William Sessions of the District of Vermont ruled that the large number of pass holders and facts of the case met the threshold for class certification.
