By Akin Gump Supreme Court Practice Group

ADVERTISEMENTS

In a split decision, the D.C. Circuit Court on Monday barred the transfer of 17 Guantanamo Bay detainees to the U.S., where they would be released, until at least late November.   A three=judge panel, with one dissent, granted the request of the Justice Department and Pentagon to postpone any transfer while the panel considers a government appeal that argues the courts have no power to require detainees to be brought into the U.S.   The order, together with a dissenting statement by one judge, can be found here.
