By classlawblog
News reports indicate that three separate U.S. Attorneys offices are investigating Lehman Brothers Holdings, Inc. (”Lehman”), in connection with Lehman’s recent bankruptcy filing. According to these reports, the prosecutors are focusing on whether Lehman’s public statements about the company’s financial condition were accurate and whether Lehman adequately disclosed the value of its assets prior to the bankruptcy.
The outcome of these investigations is impossible to determine at this time. However, if these investigations reveal that Lehman did misrepresent its financial state, Lehman and its executives may be subject to legal liability for those misrepresentations.
