: EU Law BlogOmbudsman and European Investment Bank Conclude Memorandum of Understanding
By Bartolus
The European Ombudsman and the European Investment Bank have concluded a "Memorandum of Understanding" on how complaints into maladministration by the bank should be handled.
What is striking is the expansive and reactionary definition of "maladministration" which the Ombudsman puts forward in the Memorandum. Expansive because the definition comprises not only a breach of the principles of good administration - as one would expect - but also violations of human rights and all illegal conduct. Reactionary because the document also states that "good administration" is synonymous with following established policy. That seems to equate any change in policy with maladministration.
It is rare to see an official statement so hostile to change.
Now, then, if the Ombudsman could look into bad administration by the European Central Bank, he'd be doing a great public service to all depositors in the EU.Full post as published by EU Law Blog on October 04, 2008 (boomark / email).
