Most recently, employers in Texas and California settled lawsuits that claimed they wrongfully prohibited pregnant employees from working in certain areas. In both cases, employers claimed they were just trying to do the right thing; the employees claimed discrimination. Management-side attorneys say their well-intentioned clients are in a tough spot: Protect a pregnant worker and risk a discrimination lawsuit, or let her work in a hazardous area and risk a tort claim should a child be born with a defect."

FROM THE UPCOMING ISSUE | Embattled WaMu fights patent infringement allegations while shopping for buyer
"Washington Mutual has become part of an ongoing patent infringement campaign by transaction processing firm DataTreasury Corp. against dozens of companies for allegedly infringing check-imaging technology. The case is risky for WaMu, which is shopping for a buyer or government bailout, given that a few high-profile defendants have recently settled. Also, the U.S. Patent and Trademark Office has affirmed the patents in question during a re-examination last year, said Jim Hall, a partner at Washington-based Sughrue Mion."

WEB-ONLY | Federal judge threatens sanctions against Mayer Brown, AT&T Mobility lawyers
"A federal judge took AT&T Mobility lawyers and their counsel at Mayer Brown to task in a decision this week, saying he may impose sanctions on both for alleged misrepresentations in a consumer case.
