Note:  This decision was originally posted with the 7/3/2008 COA Minutes, but was reposted with the 7/18/2008 COA Minutes with no indication on the first page of the decision of modified, etc.

However, the 7/11/2008 Minutes noted the opinion was "withdrawn" and this subsequent decision which is now on-line  was an "opinion affirming in part, vacating in part and remanding" such that something changed between the first rendering date and later.  We do not have a link or a copy of the this decision as the link now is to the current decision found in the 7/18/2008 Minutes.
