By Cleveland Law Library
On Thursday last week, the Ohio Public Defender filed suit in Franklin County Common Pleas Court seeking an injunction to prevent the execution of death row inmates with a 'cocktail' composed of 3 different drugs. The PD's office claims that the mixture could cause a long and excruciating death in violation of the Ohio Constitution and state law. Click here to read an article about the suit from the Columbus Dispatch. This suit could affect the execution of Richard Cooey, who is scheduled to die next month by lethal injection on October 14, 2008. See our prior post on Cooey's execution date and a prior moratorium on execution by lethal injection. This post will lead you to additional information on arguments that have been made and rejected about this issue.
