: Law Blog - WSJ.comIn Wake of Borat Ruling, Judge Preska Nominated to 2d Cir. High Five!
By Dan Slater
U.S. District Judge Loretta Preska has had a big couple of weeks. Last week, she tossed out suits brought by a driving instructor and two etiquette school teachers who said the makers of the movie “Borat” deceived them. Click here for a copy of the ruling. (HT: How Appealing.)
In her ruling, Judge Preska writes that “Plaintiffs seem unwilling to recognize that the operative work in the phrase ‘documentary-style’ is ’style’ and not ‘documentary.’”
We think it’s a well-reasoned interpretation of contract law. At least Preska has impressed President Bush. Yesterday, he nominated her to the Second Circuit Court of Appeals.
It’s very nice!
