Advice from (or, rather, for) the Other Side

ADVERTISEMENTS
There's a new patent prosecution blog out there. Michael Kondoudis' Patentably Defined.

I ran across this blog recently, but hadn't had the chance to get a post written before Russ Krajec at Anything Under The Sun beat me to it.

The stated purpose of the blog is to discuss 'patent prosecution strategies to help achieve allowance of claims that patentably define over cited art'.

Obviously, this blog might be of some interest to patent prosecutors. Maybe not as obviously, it may be of interest to examiners as well.

For instance, in this post, Mr. Kondoudis proposes that patent drafters might be able to have their applications taken up for examination sooner by making them 'attractive' to examiners who need an easier first action count at the end of a bi-week. An interesting strategy, to be sure.

The advice offered to make an application 'attractive' is not-so-surprisingly pretty much the antithesis of my post about applications that attempt to hide the invention from examiners (and to which a follow-up is in the works). In a nutshell, make the application clear and easy to understand.

This blog is definitely worth a look for both prosecutors and examiners.
