Advocate General Poiares Maduro suggests that the Court annul the Council Regulation freezing the funds of Mr Kadi

In his opinion, the Community Courts have jurisdiction to review measures enacted by the Community in order to implement UN Security Council Resolutions. Exercising that jurisdiction, he considers that the regulation infringes Mr Kadi?s fundamental rights under Community law.

Selon ses conclusions, les juridictions communautaires sont compétentes pour contrôler les mesures adoptées par la Communauté dans le but de mettre en oeuvre des résolutions du Conseil de sécurité des Nations unies. En appliquant cette compétence, l?avocat général considère que le règlement viole les droits fondamentaux que M. Kadi tire du droit communautaire.

Seiner Ansicht nach sind die Gemeinschaftsgerichte für die Überprüfung von Maßnahmen zuständig, die die Gemeinschaft zur Durchführung von Resolutionen des UN-Sicherheitsrats getroffen hat. Auf der Grundlage dieser Zuständigkeit gelangt er zu dem Schluss, dass die Verordnung die gemeinschaftsrechtlichen Grundrechte von Herrn Kadi verletzt.
