Ninth Circuit rules in Duncan: Relief granted

As one could predict with an opinin that begins “[o]nce again, we consider whether a capital defendant?s appointed lawyer?s performance was so deficient and prejudicial that it violated his Sixth Amendment right to counsel” the Ninth Circuit in Duncan v. Ornoski grants relief.
