TransUnion to Offer Free Credit Services in Proposed Class Settlement

By classlawblog

ADVERTISEMENTS

In one of the most expansive proposed classes ever, more than 150 million Americans could receive free credit score reports and credit monitoring services as part of a proposed settlement recently announced by TransUnion. The complaint, currently pending in the Northern District of Illinois, stems from conduct dating to 1987 and contains allegations that TransUnion culled its massive files of individual data into customized lists of consumers for sale to marketers.

The Fair Credit Reporting Act prohibits the sale of such information, except under certain circumstances. Plaintiffs alleged that anyone who had a credit file maintained by the Defendant suffered damages, mainly by their having been inundated with unsolicited spam marketing materials. Reaction to the settlement appears mixed, with some consumer advocates reportedly praising the breadth of the settlement, and others observing that consumers are already entitled to a free credit report each year. The settlement still needs to be approved by the court.
