A BIG cert denial

ADVERTISEMENTS
A big cert denial today.  The Court this morning denied certiorari in federal death penalty case, Fields v. United States. The issue in Fields was the application of the Confrontation Clause to the penalty phase of a capital trial in light of the SCOTUS?s watershed decision in Crawford v. Washington regarding that Clause. A pair of capital cases from Nevada were being held in light of Fields, and they too were denied cert today. The held cases indicate the Court may well be waiting for the right ?candidate? for cert. on this major issue.  The Confrontation Blog has more.
