New Illinois Weekly Compensation Rates

By Michael Progar

ADVERTISEMENTS
The Illinois Workers' Compensation Commission has released the new weekly compensation rates for the period from January 15, 2008 through July 14, 2008, which may be viewed and printed here. The new Statewide Average Weekly Wage will be $883.86.

Section 8(b) of the Illinois Workers' Compensation Act provides that the minimum TTD rate shall be not less than the higher of the Federal minimum wage or the Illinois minimum wage, multiplied by 40 hours. The rate is increased by 10% for each spouse and child.

Since the Illinois minimum wage is higher than the Federal minimum wage ($7.50 per hour as of July 1, 2007, vs. the Federal rate of $5.15 per hour), the minimum TTD rates are as follows for accidents occurring from July 1, 2007 through June 30, 2008:

  • 0 children or spouse - $200.00
  • 1 - $230.00
  • 2 - $260.00
  • 3 - $290.00
  • 4+ - $300.00
