State Aid: The Commission launches a consultation on the draft Guidelines on State aid to railway undertakings.

These draft Community Guidelines aim at providing guidance on the compatibility of the EC Treaty State aid rules regarding railway undertakings. Rail transport is a safe and non-polluting transport mode, which confers many advantages to it. The sector which is in the process of liberalisation is confronted with a strong competition of different transport modes and thus raises important challenges regarding Community law of State aid. These draft Community Guidelines acknowledge the railway sector’s specificities and aim at bringing along the liberalisation process of the railway sector and contributing to reinforce its competitiveness.

Aides d’État: la Commission lance une consultation sur des lignes directrices concernant les aides d’Etat aux entreprises ferroviaires.

Ce projet de lignes directrices a pour objectif de fournir des orientations sur la compatibilité avec le traité CE des aides d’Etat aux entreprises ferroviaires. Le transport ferroviaire est un mode de transport sûr et non polluant, ce qui lui confère de nombreux atouts. Secteur en cours de libéralisation, confronté à une concurrence intermodale forte, il pose des défis spécifiques au regard du droit communautaire des aides d’état. Le projet de lignes directrices, qui reconnaît ces spécificités du rail, vise à accompagner le mouvement de libéralisation de ce secteur et contribuer à renforcer sa compétitivité.

Staatliche Beihilfen: Die Kommission beginnt eine Anhörung bezüglich der Gemeinschaftlichen Leitlinien für staatliche Beihilfen an Eisenbahnunternehmen

Das Ziel des Leitlinienentwurfes ist es, eine Orientierungshilfe für die Vereinbarkeit von staatlichen Beihilfen für Eisenbahnunternehmen mit dem EG-Vertrag zu bieten. Als sicherer und umweltfreundlicher Transportmodus bringt der Eisenbahnverkehr besondere Vorteile mit sich. Dieser sich in Liberalisierung befindliche Sektor steht unter starkem intermodalem Konkurrenzdruck und stellt in Bezug auf die Gewährung staatlicher Beihilfen im Rahmen des Gemeinschaftsrechts spezifische Herausforderungen dar. Der Leitlinienentwurf erkennt diese Besonderheiten der Schiene an und bezweckt die Liberalisierung des Sektors zu begleiten sowie seine Wettbewerbsfähigkeit zu stärken.
