What's new at the Atlanta PERM Center?

By Joel Stewart

ADVERTISEMENTS

The latest numbers on the

DOL

page (http://www.dol.gov/ ) include figures on wages, price index, salaries, but nothing on

PERM

! Actually, the

DOL

has an extraordinary page dedicated to PERM.

At first when I opened the link, I thought I had opened a page from the Chamber of Commerce in

Perm

,

Russia

. By now everyone knows that there are two PERMS. The original one is a city in

Russia

called

Perm

, and the newer one is the

PERM

labor certification program.

Seriously, this page is really interesting, because it shows a side of

DOL

that we rarely see -- a pro-certification presentation of the Foreign Labor Certification Program. Take a look: (http://www.foreignlaborcert.doleta.gov/pdf/PERM_Data_FY07_Announcement.pdf ).

The page opens to a colorful brochure in red (like

Perm

in

Russia

!) and boasts detailed information about the

PERM

program in the

US

. The program is intended to serve a global need to attract labor to the

U.S.

This is indeed true! In fact, this is the first time I have ever read anything positive about the foreign labor certification program written by

ETA

DOL

.

The

PERM

program is mapped to sectors of the economy: Information Technology, Advanced Manufacturing, Educational Services, Financial Services, Health Care Services, Hospitality & Tourism, Construction, Aerospace, Retail Trade, Biotechnology, Automotive Services, Agribusiness, Transportation & Distribution, Energy, and Geospatial Analysis.

There is a section on "top" participants. The largest

PERM

users in 2007 were Microsoft Corporation, Cognizant Technology Solutions, Oracle USA, Inc., Intel Corporation, Ernst & Young, LLP, Motorola, Inc., Cisco Systems, Inc., Texas Instruments Incorporated, Infosys Technologies Limited, Rapidigm, Inc.

Top Countries of Citizenship:

India

24,573;

China

6,846;

Mexico

6,442;

South Korea

5,159;

Canada

4,837.

The site includes the number of workers in companies with PERM cases certified, showing the largest number of certification in very large companies, and a state by state breakdown of certifications, starting with California with 20,222, followed by New York, New jersey, Texas and Florida, and at the low end Oklahoma, with 348!

At the same time, there are many other pages on the web devoted to interpreting

PERM

data. Sites like ""trackitt" offer interesting views of the

PERM

process. See http://www.trackitt.com/usa-immigration-trackers/atlanta-perm-tracker.

While looking at 2007 figures, remember that the

DOL

began a crackdown in late 2007, after the Backlog Centers were closed. The figures for 2008 should be more conservative.

The new PERM Book II has a section on useful sites.

Meanwhile, on March 28 the

DOL

issued another round of FAQ's, called, "Fraud Rule -- Round II". The FAQ's deal with Motions to Reconsider, errors on applications and Schedule A, but have nothing to do with Fraud.

The term "fraud" seems misplaced, since the FAQ's have nothing to do with Fraud.
