Medical Mistake Led to Abortion, Lawsuit Filed

By Jenny Albano

ADVERTISEMENTS

A woman has filed a lawsuit against the Iowa Methodist Medical Center because she says that a medical mistake caused by the hospital led to her have an abortion.

Kristy Oswald claims that hospital employees did not tell her a test showed she was pregnant. The test was completed just before she had a heart procedure done in 2006 to treat abnormal heart rhythms. Oswald's attorney, Guy Cook, stated the procedure and the anesthesia raised serious risks to Oswald's fetus.

Oswald, 47, a nurse at the hospital, normally opposes abortion but decided to terminate the pregnancy because the fetus may have been damaged.  She learned in the recovery room that she was five weeks pregnant.

Hospital officials released a statement on Thursday expressing their regret for the situation and want to help the patient and family reach a resolution as quickly as possible.
