Oracle, Unisys File Requests for Notice in SCO Bankruptcy

By Pamela Jones et al.

ADVERTISEMENTS
Oracle America and Unisys have each filed a Request for Notice in the SCO bankruptcy. Unisys's filing is also an official entry of appearance. Why now, you are asking? The court clerk entered them into the docket as Notices of Appearance, but Oracle's is actually a Request for Special Notice, asking to be informed of any developments. Oracle requests that "notice of any and all proceedings in the above captioned case be given to its attorneys, Magnozzi & Kye" and specifically to Amish R. Doshi, who appeared telephonically at the hearing.

I assume they'd like to know if there is an appeal filed by Novell, but also, although there was an agreement between Oracle and SCO announced at the recent bankruptcy hearing, it was a partial agreement, with the proviso that Oracle retained its rights should a complete agreement not be reached. If they didn't agree and SCO went ahead, believing it could do so even without Oracle's agreement, obviously Oracle wants to know about it.

As for Unisys, their filing is titled Entry of Appearance and Request for Notices. They'd like "all notices, pleadings and other papers filed" sent to them. As to why, all I can point out is that Unisys has an employee on the unXis advisory board, William Bancroft, VP and General Manager of Unisys Global Outsourcing and Infrastructure Services. So does Microsoft. Still think this is just little SCO and that the danger is over? Now do you understand why, after OSI and FSF asked the US Department of Justice to take a look at the proposed patent deal between Novell and the Microsoft-organized entity CPTN, they are apparently taking it seriously?
