: PA Brownfields Environmental LawNew MSCs Won't Result in Changes to Regulated Fill Tables
By Joel Bolstein
In January, the revisions to the Act 2 medium specific concentrations (MSCs) became final when the changes to Chapter 250 were published in the Pennsylvania Bulletin. Recently, I asked Troy Conrad, the Director of the Land Recycling Program, whether the new MSCs would result in any changes to the allowable concentration levels for regulated fill. Troy said that the new MSCs are not expected to result in any changes to Tables GP-1a and GP-1b which are appendices to the General Permit for Regulated Fill, GP096 , which authorizes regulated fill to be beneficially reused as construction material. PADEP considers the concentration limits reflected in the Tables to be safe and protective of human health and the environment under the conditions set forth in the Regulated Fill GP.
