How to evict a roommate?


Two months ago, I began renting a house with 3 other roommates. Three of us were known to the landlord and are on the lease. The fourth one was unknown to the landlord and moved in with the understanding that he would either soon be on the lease or have a sublease. Unfortunately, this extra roommate did not work out for both personal reasons, and some more serious reasons (drug usage, noise disturbance to neighbors, questionable 'repairs' to the property that are essentially damages, and threatening the landlord). We never drew up a sublease agreement, nor worked anything out with the landlord about his occupancy. We are now at am impasse in getting him to leave. The landlord does not grant permission for this person to stay, and thinks that this extra roommate is trespassing, as his name is not on the lease. The landlord wants the sheriff to remove him from the property. If this is not successful, the landlord will give us three lease holders a 3-day eviction notice for violating the lease agreement. The lease specifically stated that any additional tenant or subletter would have to be run by the landlord first. I have been trying to work out a deal for him to move out peacefully, to avoid either of the above scenarios, and have not yet been successful. So my questions are: Will the landlord be successful in having the extra person removed from the property? Do I have any ability to evict the extra person as his un-written landlord? Will the landlord have cause to evict us lease holders if the extra person is not removed? As a followup to the last question, I do not really want to live with any of these people any longer, as drug use has become a major problem. How does an eviction work with multiple parties on the lease? If I do not fight the eviction, but the other lease holders do, how might this turn out? Is there a better way to get out of the situation? Furthermore, the extra person stated that he would and could stay even when the three lease holders are evicted. Is this true, and how would the landlord proceed from here? Finally, what, if any, legal consequences could be brought to me by this extra person? If any, are these consequences shared among the three lease holders, or can I face more as I have essentially been the front-man of this whole fiasco?
