What options if any are available to mishandling of a case resulting in declined prosecution

My brother was murdered 25 yr.s ago and the investigation was grossly mishandled by detectives and WSP technician. There was a piece of evidence on the murder weapon that coudn't be attributed to the suspect, which resulted in declining prosecution. With new technology, they have been able to identify the evidence as belonging to a lab tech but have refused to comment as to the possibilty of pursuing prosecution now. What are my families options if any?
