Nursing Home had No insurance!

My grandmother died from injuries of nursing home abuse and neglect. the facility recieved an intent to sue letter and then allowed the insurance policy to lapse for 2 weeks. the policy was rewritten through the same company. it was a claims made policy so it provided no coverage and the new policy that replaced it considered my claim as a pre existing so it provides no coverage. The insurance company offered a settlement of 35,000. Is that the bottom line- just take what is offered or is there a way to get one of the policies to cover the claim?
