Does a will have to be followed or can the heirs divide an estate equally by mutual consent?
Over the years Mom has said each of her 3 kids is a favorite and will inherit everything.($800,000). She likes turmoil. She changes her will monthly and makes it known. Years ago the 3 of us said, let's split 3 ways and remain as a family no matter what the will says. Can we do that? I will probably be executor. Right now my 14 yr old gets it all. Suggestions?? Should I mention this to her lawyer?
