Missouri Attorney General's Office Lawsuit
$26,000 settlement reached in disability discrimination lawsuit, pending court approval.
Missouri Attorney General's Office to pay $26,000 settlement in disability discrimination lawsuit.
Jefferson City, MO: (May-28-08) Marla Grothoff, a quadriplegic woman, brought charges against Attorney General Jay Nixon's office, alleging that she was discriminated against on the basis of her disability. Records show that Grothoff was one of 16 attorneys in the Department of Social Services' Child Support Enforcement Division whose jobs were eliminated when some of their duties were transferred to the attorney general's office in 2003. Investigations reveal that 12 of those attorneys were hired by Nixon's office, but Grothoff was not. Following that, she sued in October 2004 in Boone County Circuit Court, claiming discrimination under the Americans With Disabilities Act.Court papers indicate that the suit was transferred to federal court, where Magistrate William Knox ruled in July 2006, stating that there was enough of a dispute about whether she was qualified for the attorney general's office job as to allow her discrimination lawsuit to go forward. As part of a settlement reached in the case, Attorney General Jay Nixon's office has agreed to pay $26,000 to resolve allegations. Additionally, the deal also provides retirement benefits.
