When Government Inversely Condemns Property by Regulation, Magnitude of State Interest Has No Bearing Upon Just Compensation

The New Jersey Supreme Court recently decided a case in which a property owner sued the Department of Environmental Protection (DEP) for just compensation after the Office of Administrative Law affirmed the DEP’s rejection of the property owner’s application for a hardship waiver from the Flood Hazard Area Control Act Rules.
